Missouri just passed SB 973 that goes into effect 8/28/26. Anyone who meets Missouri’s definition of a “wholesaler” (assignments/novations) must provide the seller with a separate written disclosure (signed/dated by both parties) at least 14 calendar days before the purchase contract is signed.
If the wholesaler fails to provide the required disclosure, the seller can cancel the transaction at any time before closing. In addition, the seller may be entitled to receive the wholesaler’s earnest money deposit. Violations can trigger consumer protection claims.
